Welcome to ezmeds.co (the "Site"), operated by Rosetti Pharma LLC, a Wyoming limited liability company ("EZMedsPharmacy", "EZMeds", "we", "us", or "our").

These Terms of Service ("Terms") govern your access to and use of the Site and any related services, including telehealth consultations, prescription services, membership programs, subscriptions, and product purchases (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or Services.

1. Eligibility & Geographic Restrictions

  • The Services are intended only for individuals who:
    • Are at least 18 years of age, and
    • Are physically located in, and residents of, the United States in a state where our Services are available.
  • By using the Services, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.
  • We currently ship and provide medication only within the United States. We do not serve users outside the United States.

2. Nature of Services

EZMeds provides access to telehealth and pharmacy-related Services, which may include:

  • Online intake forms and health questionnaires;
  • Virtual consultations with licensed healthcare professionals;
  • Prescribing of medications when medically appropriate;
  • Dispensing and shipment of medications through licensed pharmacies;
  • Memberships and subscription-based medication services.

All clinical decisions, including whether to prescribe a medication and which medication to prescribe, are made solely by licensed healthcare professionals based on their independent clinical judgment.

3. No Emergency Services

The Site and Services are not intended for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

4. Account Registration & Security

  • You may be required to create an account to access certain Services.
  • You agree to:
    • Provide accurate, current, and complete information during registration;
    • Maintain and promptly update your information as needed;
    • Maintain the confidentiality of your login credentials; and
    • Immediately notify us at help@ezmeds.co of any unauthorized use of your account.
  • You are responsible for all activity that occurs under your account.

5. Telehealth & Prescription Process

  • Completion of an online questionnaire or consultation does not guarantee that a prescription will be issued. Prescriptions are only provided when medically appropriate.
  • You agree to:
    • Provide truthful and complete health information;
    • Disclose all current medications, allergies, and relevant medical history;
    • Follow the instructions of the prescribing clinician and pharmacist; and
    • Use prescribed medications only as directed and only for the person to whom they are prescribed.
  • Misuse of prescription medications, including sharing or resale, is strictly prohibited and may be unlawful.

6. Medical Information & Content

  • Any educational or informational content on the Site (including FAQs, articles, or product descriptions) is provided for general informational purposes only.
  • Such content does not constitute medical advice, diagnosis, or treatment and should not replace consultation with a licensed healthcare professional.
  • Only the licensed clinicians providing your care can give you personalized medical advice through the telehealth Services.

7. Purchases, Pricing & Payments

  • By placing an order on the Site, you agree to pay all charges applicable to that order, including the price of products, Services, taxes, and any shipping fees.
  • Prices, fees, and available products are subject to change at any time without notice, but changes will not affect orders already placed and confirmed.
  • We may use third-party payment processors to handle payments. By submitting payment information, you authorize us (and our payment processors) to charge the payment method you provide.

8. Memberships & Subscriptions

  • We may offer:
    • One-time purchases of medications or products;
    • Recurring subscriptions for medications or Services; and
    • Membership programs that provide access to certain benefits.
  • By enrolling in a subscription or membership, you agree that:
    • Subscription and membership fees will be charged on a recurring basis (e.g., monthly) until cancelled;
    • Your selected payment method will be automatically billed for each renewal period;
    • Membership fees are non-refundable once charged;
    • Subscriptions must be cancelled at least 10 days before the next billing date to avoid renewal charges for the upcoming cycle.
  • You may cancel your subscription or membership at any time by:
    • Managing your account settings (if available), or
    • Contacting us by email at help@ezmeds.co.

9. Cancellations, Returns & Refunds

  • Cancellations of subscriptions or memberships will apply to future billing cycles and do not automatically entitle you to a refund for past charges.
  • Our policies for returns and refunds of products are described in our separate Returns & Refunds Policy, which is incorporated into these Terms by reference.
  • Certain items, including memberships, billed subscriptions, and sale items, are not refundable. Please review our Returns & Refunds Policy before making a purchase.

10. Shipping & Delivery

  • We currently only ship within the United States.
  • Details about shipping methods, delivery times, and shipping fees are described in our separate Shipping Policy, which is incorporated into these Terms by reference.
  • Risk of loss and title to products pass to you upon our delivery of the order to the carrier.

11. Chargebacks & Dispute Procedure

  • If you have an issue with your order, billing, or the Services, you agree to:
    • First contact us at help@ezmeds.co to allow us a reasonable opportunity to resolve the issue.
  • Initiating a chargeback without first attempting to resolve the matter with us may be considered a breach of these Terms.
  • Nothing in these Terms is intended to limit your rights with your bank or card issuer, but you agree to cooperate with our investigation of any disputed charges.

12. Prohibited Conduct

You agree not to:

  • Use the Site or Services for any unlawful purpose;
  • Provide false, misleading, or incomplete information;
  • Attempt to obtain prescriptions or medications for any person other than yourself;
  • Resell, distribute, or divert prescription medications;
  • Interfere with or disrupt the operation of the Site or Services;
  • Reverse-engineer, decompile, or attempt to obtain the source code of the Site;
  • Gain unauthorized access to other users’ information or the Site’s systems.

13. Intellectual Property

  • The Site, including all text, graphics, logos, images, and software, is owned or licensed by Rosetti Pharma LLC and is protected by copyright, trademark, and other intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.
  • You may not reproduce, distribute, modify, or create derivative works of any content on the Site without our express written permission.

14. Privacy

  • Your use of the Site and Services may involve the collection and use of personal and health-related information.
  • Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Disclaimers

  • To the maximum extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not guarantee that the Site will be uninterrupted, secure, or free from errors or viruses.
  • We make no representations or warranties regarding the suitability, reliability, availability, timeliness, or accuracy of the Services for any purpose, except as required by applicable law or explicitly provided by a treating clinician.

16. Limitation of Liability

  • To the fullest extent permitted by law, Rosetti Pharma LLC and its owners, officers, employees, contractors, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of (or inability to use) the Site or Services.
  • Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us for the specific product or Service giving rise to the claim.
  • Some jurisdictions do not allow limitations on certain types of damages, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Rosetti Pharma LLC and its owners, officers, employees, contractors, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Services;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation; or
  • Your negligence or misconduct.

18. Governing Law & Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
  • Subject to any mandatory arbitration or dispute resolution requirements under applicable law, you agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

19. Changes to the Terms

  • We may update or modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page.
  • Your continued use of the Site or Services after any changes become effective constitutes your acceptance of the revised Terms.

20. Termination

  • We may, in our sole discretion, suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or applicable law.
  • Upon termination, your right to use the Site and Services will immediately cease, but any obligations or liabilities incurred prior to termination will survive.
